Welcome to DutyTick. These Terms of Service ("Terms") govern your access to and use of our attendance tracking service. By using DutyTick, you agree to these Terms.

1. Acceptance of Terms

By accessing or using DutyTick, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use our service.

2. Description of Service

DutyTick is an attendance tracking system that allows employees to log their attendance via Telegram or a web application. The service includes:

  • Telegram bot for message-based check-in/check-out
  • Web application for photo and location verification
  • Admin dashboard for managing attendance data
  • Reporting and data export features

3. User Accounts

To use DutyTick, you must:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Be at least 16 years of age
  • Notify us immediately of any unauthorized use of your account

You are responsible for all activities that occur under your account.

4. User Responsibilities

When using DutyTick, you agree to:

  • Provide accurate attendance information
  • Use the service only for legitimate attendance tracking purposes
  • Not attempt to disrupt or compromise the service
  • Not use the service to violate any applicable laws or regulations
  • Not share your account credentials with unauthorized parties
  • Not reverse engineer, decompile, or attempt to extract source code

5. Data Accuracy and Usage

You are responsible for the accuracy of the attendance data you provide. We are not responsible for any consequences resulting from inaccurate or fraudulent data submission.

6. Telegram Integration

Our service integrates with Telegram, a third-party messaging platform. By using our Telegram bot:

  • You agree to Telegram's Terms of Service and Privacy Policy
  • You authorize our bot to access your Telegram user ID and messages
  • You understand that we cannot control Telegram's availability or performance

7. Subscription and Payment

Pricing information will be provided upon launch. By subscribing to a paid plan:

  • You agree to pay the fees associated with your selected plan
  • Fees are billed in advance on a recurring basis
  • All fees are non-refundable except as required by law
  • We reserve the right to change pricing with 30 days' notice

8. Cancellation and Termination

You may cancel your subscription at any time. We reserve the right to suspend or terminate your account if you:

  • Violate these Terms
  • Fail to pay applicable fees
  • Engage in fraudulent or abusive behavior
  • Use the service in a way that harms DutyTick or other users

Upon termination, your access to the service will cease, and we may delete your data in accordance with our retention policy.

9. Intellectual Property

DutyTick and all associated content, features, and functionality are owned by Hardcode Consulting Private Limited and are protected by intellectual property laws. You may not:

  • Copy, modify, or distribute our content without permission
  • Use our trademarks, logos, or branding without authorization
  • Create derivative works based on our service

10. Limitation of Liability

To the maximum extent permitted by law, DutyTick and its affiliates shall not be liable for:

  • Indirect, incidental, special, or consequential damages
  • Loss of profits, data, or business opportunities
  • Service interruptions or data loss
  • Actions or omissions of third parties (including Telegram)

Our total liability shall not exceed the amount you paid for the service in the 12 months prior to the claim.

11. Disclaimer of Warranties

DutyTick is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

  • Warranties of merchantability or fitness for a particular purpose
  • Guarantees of uninterrupted or error-free service
  • Accuracy, reliability, or completeness of content

12. Indemnification

You agree to indemnify and hold harmless DutyTick, Hardcode Consulting Private Limited, and their affiliates from any claims, damages, or expenses arising from:

  • Your use of the service
  • Your violation of these Terms
  • Your violation of any third-party rights

13. Data Privacy and Security

We take data privacy seriously. Please review our Privacy Policy to understand how we collect, use, and protect your information. While we implement security measures, no system is completely secure, and we cannot guarantee absolute security.

14. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by:

  • Posting the updated Terms on our website
  • Sending you an email notification
  • Displaying a notice in the service

Your continued use of DutyTick after changes are posted constitutes acceptance of the new Terms.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of India. Any disputes arising from these Terms or your use of DutyTick shall be resolved through:

  • Good faith negotiation between the parties
  • Binding arbitration if negotiation fails
